My boyfriend came here from Germany on a student (F1) visa. We are now engaged and are wondering what to file?
We will marry next June before his Visa expires. Does he just need a change of status and if so, is he able to leave the country or does he have to wait a certain amount of time? He does NOT want to be a permanent resident, only a nonimmigrant with permission to stay.

You need the following: I-485 - Application to Register Permanent Residence or Adjust Status I-765 - Application for Employment Authorization It is best not to exit the country until the application is approved.

See an immigration consultant to file for a K1 or K3 visa for you. It will give him permanent status but who cares if he sues it or not.
